C — Positioning Modules
Dementia Care, Substitute Decision-Makers & Guardians
Why authority replaces simple consent
- The individual may be unable to give or withhold consent at the moment of request.
- A family member may or may not hold legal decision-making authority.
- Authority may be partial: medical decisions but not financial, or the reverse.
- Authority may change over time and must be revocable.
- Multiple family members may make conflicting requests.
Positioning module
A. Public Regis position
Regis publicly describes dementia care services and supports, and its privacy policy addresses consent, withdrawal of consent and authorised representatives. Care-service source Privacy and governance source
B. Operational significance
- Staff must know quickly who may receive information.
- Guardianship and enduring-power arrangements vary by individual and jurisdiction.
- Errors carry both privacy and family-relationship consequences.
C. Relevant CareBand patent position
- Verification of authority as distinct from role
- Relationship-specific disclosure
- Revocable, scope-limited permissions
D. Potential functional alignment
A guardian's request may return the categories within their legal scope; a non-authorised relative may receive only a wellbeing summary, and only where consent or policy permits.
E. Technical information still required
- whether legal authority is modelled distinctly from family relationship
- whether authority scope is expressed per information category
- how revocation is propagated
F. Commercial relevance
Authority-aware disclosure is difficult to add later and is a frequent source of privacy complaints in dementia care.
Where consent cannot be given directly, the disclosure decision must be computed from verified legal authority, relationship and purpose rather than assumed from familiarity.
Technical implementation not publicly disclosed.
